The Texas House Committee on State Affairs recently convened to address House Bill 28, a proposal that seeks to impose stringent regulations on hemp-derived consumable products in the state.
Concerns Over Product Safety
During the hearing, the Allen Police Chief likened stores selling hemp-derived items to “candy stores or fireworks stands,” suggesting that the colorful packaging acts as bait for children. This sentiment was echoed by other stakeholders worried about the potential for increased youth access to consumable hemp products. In contrast, a Kentucky-based hemp business representative noted that a significant portion of their Texas clientele consists of women over the age of 55 living in suburban areas.
Understanding House Bill 28 and Senate Bill 3
House Bill 28, presented by State Affairs Chairman Ken King, aims to create a more regulated framework for the hemp industry while still permitting the sale of certain consumable products that contain THC. Although this bill bans synthetic THC and most smokable hemp items, it allows for drinkable hemp products, which would be overseen by the Texas Alcoholic Beverage Commission. In contrast, Senate Bill 3, introduced as a priority by Lieutenant Governor Dan Patrick, seeks to ban all products containing any level of tetrahydrocannabinol (THC).

Since the passage of the 2018 federal farm bill and subsequent state legislation in 2019 that legalized hemp, Texas has seen a burgeoning market estimated to be worth between $3 to 4 billion. Experts, such as Robin Goldstein, a cannabis economist, argue that regulating hemp products enhances safety rather than increases their prevalence. Goldstein explained, “Legalizing hemp products doesn’t make them more common, but makes products safer and better regulated.”
The Debate Over THC Regulations
While some advocates are concerned about the disproportionate targeting of THC-infused food products, King defended the distinction made for beverages, suggesting they are less likely to be mistaken for children’s snacks. Nonetheless, the proposed regulatory measures could significantly curtail the variety of products available to consumers in Texas.

King acknowledged that the changes in regulations could negatively affect businesses but emphasized the necessity of a structured approach. “It’ll certainly be negative because you’re shrinking what can legally be produced and manufactured for consumption,” he noted. “But I do think at some point the regulatory environment is going to exist.”
